1. Acceptance of Terms

By accessing and using Skinixa ("the Service"), including our website and mobile application, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

Skinixa is an AI-powered skincare recommendation platform that provides personalized skincare routine suggestions, skin health analysis, food impact scoring, and guided routine timers based on user-provided information.

2. Description of Service

Skinixa provides:

• AI-powered skincare product recommendations matched to your skin type, concerns, and budget
• Personalized morning and night skincare routines (cleanser, toner, serum, moisturizer, sunscreen)
• AI skin analysis with health scores across clarity, texture, tone, hydration, and radiance
• Food scanner that analyzes food items for their impact on skin health via photo, barcode, or text search
• Progress tracking with photo comparison and trend analysis
• AI-guided routine timers with estimated application times per step
• AI Skincare Advisor chatbot for personalized questions and guidance
• Product replacement with alternative recommendations
• Access to a curated database of 1,500+ skincare products from trusted retailers
• One-tap Amazon cart for purchasing entire routines

3. Subscription Plans and In-App Purchases

3.1 Subscription Tiers

Skinixa offers three tiers of access:

3.2 Billing and Auto-Renewal

• Subscriptions are billed monthly through the Apple App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price

3.3 Cancellation and Refunds

• You can cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions)
• Cancellation takes effect at the end of the current billing period — you retain access to paid features until then
• No partial refunds are provided for unused portions of a subscription period
• Refund requests are handled by Apple in accordance with their refund policies
• After cancellation, your account reverts to the Free tier with its associated limits

3.4 Price Changes

• We reserve the right to change subscription pricing with advance notice
• Existing subscribers will be notified of price changes before their next renewal
• Continued use of a paid subscription after a price change constitutes acceptance of the new price

3.5 Free Trial

• If a free trial is offered, it will be clearly stated at the time of sign-up
• Any unused portion of a free trial is forfeited when you purchase a subscription

4. User Accounts

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

The recommendations, skin analysis scores, and food impact scores provided by Skinixa are for informational purposes only and should not be considered medical advice, diagnosis, or treatment. Our AI analyzes product compatibility based on ingredient analysis, general skincare principles, and user preferences — not medical conditions.

Food scanner results indicate general potential skin impact based on nutritional properties and are not dietary or medical recommendations.

Skin analysis scores (clarity, texture, tone, hydration, radiance) are AI-generated estimates and should not be used as a substitute for professional dermatological assessment.

Always consult with a qualified healthcare provider or dermatologist before starting any new skincare routine, especially if you have skin conditions, allergies, or sensitivities. Skinixa is not responsible for any adverse reactions or results from products recommended through the Service.

6. AI Features and Limitations

Skinixa uses artificial intelligence to provide product recommendations, skin analysis, food scoring, routine timing, and chatbot assistance. You acknowledge that:

• AI recommendations are based on algorithms analyzing ingredient compatibility, not guaranteed outcomes
• Product matching uses validated data with confidence scores, but accuracy may vary
• Skin analysis scores are AI estimates based on photo analysis and may not reflect clinical assessments
• Food skin impact scores are informational estimates and not nutritional or medical advice
• Routine timer durations are AI-estimated suggestions for optimal product application
• The AI Skincare Advisor provides general skincare guidance and should not replace professional advice
• AI-generated insights are suggestions, not medical or dermatological assessments

7. Product Links and Affiliate Disclosure

Skinixa provides links to third-party retailers (including Amazon, Ulta, Sephora, and others) where recommended products can be purchased. Some of these links may be affiliate links, meaning we may earn a commission if you make a purchase through these links at no additional cost to you.

We are not responsible for the quality, safety, or legality of products sold by third-party retailers, nor for the accuracy of their product descriptions or pricing. All purchases are made directly with the retailer and are subject to their terms and conditions.

8. User Data and Photos

When using Skinixa's progress tracking and skin analysis features, you may upload photos of your skin. By uploading photos, you acknowledge that:

• Photos are stored securely and used only for your personal progress tracking and AI analysis
• AI analysis of photos is for informational purposes only
• You have the right to delete your photos and data at any time
• We do not share your photos with third parties without your explicit consent
• Photos are not used to train AI models

9. User Responsibilities

When using Skinixa, you agree to:

• Use the Service only for lawful purposes
• Provide accurate information about your skin type, concerns, and preferences

• Not use the Service to harm, harass, or impersonate others
• Not attempt to access unauthorized areas of the Service
• Patch test new products before full application
• Discontinue use of any product that causes irritation
• Not misuse the AI Skincare Advisor for purposes other than skincare guidance
• Not attempt to circumvent subscription tier restrictions

10. Budget and Pricing

Skinixa provides budget-aware recommendations designed to stay within your specified budget. However, you acknowledge that:

• Product prices are fetched from third-party retailers and may change without notice
• We aim to recommend products within your budget but cannot guarantee exact pricing
• Final purchase prices are determined by the retailer at the time of purchase
• Budget calculations are estimates based on available pricing data
• Subscription pricing is separate from product budget and is billed through the App Store

11. Service Availability

Skinixa is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

The mobile application is available through the Apple App Store and is subject to App Store availability and policies. We are not responsible for App Store outages or restrictions that may affect your ability to download, update, or use the app.

12. Intellectual Property

All content on Skinixa, including but not limited to text, graphics, logos, algorithms, AI models, and software, is the property of Skinixa and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written permission.

13. Limitation of Liability

To the fullest extent permitted by law, Skinixa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of the Service
• Any bugs, viruses, or malware transmitted through the Service
• Any adverse reactions to products recommended through the Service
• Inaccuracies in AI-generated recommendations, skin scores, food scores, or chatbot responses
• Discrepancies between estimated and actual product prices
• Issues related to subscription billing handled by the App Store
• Loss of subscription access due to payment failures or account issues

14. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the Service will immediately cease and any active subscriptions will be cancelled.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
